Travis Barker Suing

Pilot error and defective equipment are the likely causes of the plane crash that injured Travis Barker and DJ AM and killed 4 others. Travis Barker is suing, which I understand. Although I have to admit when I first read it, I thought, "I'd just be happy to be alive."

Travis Barker has filed a lawsuit blaming the pilots and defective equipment for a plane crash that severely injured the rocker and DJ AM and killed four others.

The L.A. Superior Court lawsuit, also filed Friday by the mother of Barker's bodyguard, Charles "Che" Still, who died in the crash, alleges the pilots "negligently decided to abort" the takeoff when the Learjet's tires failed in September at an airport in Columbia, S.C.

"The pilots were either poorly trained and/or failed to follow their training," the suit says. "The pilots' decision was a breach of their duty owed to the passengers onboard and was a substantial factor in causing the crash and resultant injuries and deaths."

Pilot Sarah Lemmon, 31, and co-pilot James Bland, 52, were killed in the crash, as were Barker's assistant Chris Baker, 29, and Still, 25.

The lawsuit also alleges that one or more of the tires failed, "leaving tire debris and portions of airplane components along the 8,600-foot runaway" and that the plane's landing gear, tires, wheels, brakes, reverse thrust system, and squat switches "were not airworthy."

Barker, who is recovering from severe burns, is claiming the crash caused him pain and suffering, mental anguish, psychological and emotional distress, disfigurement, loss of earnings capacity and medical expenses.

Federal aviation officials are focusing on bare tires and debris on the runway as the causes of the crash. The National Transportation Safety Board says the wheels had very little rubber remaining and its brakes were severely damaged.

The lawsuit names as defendants Clay Lacy Aviation, Global Executive Aviation, Inter Travel and Services, Goodyear Tire and Rubber and Bombardier Inc.

Shanna Moakler Talks About Travis, Crash

"I just got the phone call you dread," Shanna Moakler tells Extra in her first TV interview since ex-husband Travis Barker's Sept. 20 plane crash.

"I actually thought when the phone rang, that it was Travis saying, 'Oh, we landed in L.A. and I'm coming to you babe,'" she says in the interview scheduled to air Friday night.

Moakler reveals that Barker had a bad feeling about the doomed flight before he boarded.

"He had taken pictures of the plane and sent them to me … He had a feeling that something was about to happen," she says.

Of the six people on board, Travis and friend DJ AM (who described the crash in a PEOPLE exclusive) were the sole survivors.

"They were just in the back of the plane and Travis remembered where the emergency exit was," says Moakler. "It's miraculous."

The former Miss USA admits they probably won't be flying anytime soon. "We're going to invest in a tour bus," said Moakler. "Hopefully we will see a big AM-Travis show in the future."

Moakler remains coy about her relationship with her ex but admittes she'd like to have more children. She and Barker have two kids together, Landon, 5, and Alabama, 2.

"Travis is my family … I have a profound love for him and the rest you'll just have to wait and see," she says.

Travis Barker Takes To His Blog

Travis Barker took to his blog to post pics of himself in the hospital and thank everyone for their support following the plane crash he and DJ AM survived. It's hard not to notice the diss to ex-wife Shanna Moakler. There was lots of press surrounding her rushing to be by Barker's side after the crash. Guess a happy reunion is NOT in store for the couple at this time. Hopefully a happy reunion between Travis and his kids will happen soon.

Here's what Travis had to say about Shanna: Despite any rumors you might have heard via my EX-wife Shanna Moakler, who I have not seen since the week I checked in, Ive been treated amazingly well, both here in LA and in Georgia. The hospitals Ive been treated at are THE BEST.

More Info About Travis Barker

Shanna Moakler is sticking by her ex-husband and father to their two children, Travis Barker, as he heads back to LA. He's headed back to California by bus. Sources say, "Trust me, [Travis] will never fly again – ever."

Barker, 32, was released from the Joseph M. Still Burn Center at Doctors Hospital Another source tells PEOPLE: "Trust me, [Travis] will never fly again – ever."

As for the state of the musician's health, "he's not in good shape," says the source. "It's still serious. It's very serious.”

Travis Barker Released From Hospital

Great news for Travis Barker. I wonder who will get the first interview with him & DJ AM?

After nine days, Travis Barker has been released from the Joseph M. Still Burn Center at Doctors Hospital in Augusta, Georgia, PEOPLE has learned.

"Travis is in good condition and was discharged this morning," Burn Center spokesperson Beth Frits told PEOPLE Monday. "He has left Augusta."

The musician, 32, was admitted in critical condition in the early hours of Sept. 20 after a Learjet 60 carrying him and five others crashed upon takeoff from the South Carolina's Columbia Metropolitan Airport, about an hour away.

DJ AM Home In LA

DJ AM, who along with Travis Barker, survived a plane crash last Friday is home in LA. Perez Hilton told Access Hollywood that AM returned home via bus. A fact he didn't mention on his blog. Weird. Anyway, Travis Barker is still in the hospital and is hoping to be released in a couple of weeks. I hope they're doing well and are back to making music as soon as they're up for it. They were the highlight of this year's VMA's as far as I'm concerned. I think alot of people felt that way.

DJ AM, whose real name is Adam Goldstein, has been released from the hospital after suffering injuries from a plane crash that killed four people last week, his rep confirmed to Access Hollywood.

“Adam Goldstein has been released from Doctors Hospital,” the rep said in a statement. “While he is deeply saddened by the events he is thankful for all of the love and support he has been receiving from fans and friends world wide. We ask that you continue respect his privacy as he rests and heals and mourns the loss of his friends”.

And the DJ is already back home in L.A.


“I’ve been speaking with him this week. He just got back to Los Angeles,” Perez Hilton told Access Hollywood on Thursday night.

The gossip blogger says he’s “good friends” with the DJ. According to Perez, Adam arrived back home on Thursday – by bus.

“That might tell you something about his desire to use or not use airplanes in the future,” Perez said.


But while DJ AM has returned, fellow passenger and TRVSDJ-AM musical collaborator, Travis Barker remains in the hospital.


“[Adam] just said to me to pray for Travis, so that makes me a little concerned that Travis’ injuries might be more severe than his were,” Perez said.


According to People, Barker pal and hip-hop mogul Jermaine Dupri says the former Blink-182 drummer will be in the hospital for another two weeks.

“He’s doing good, he’s gonna be alright. He’s just got a lot of healing to do,” Dupri told the mag.


Barker has undergone several surgeries for burns over his torso and lower body, the Associated Press reported. He and DJ AM were severely injured in a Learjet crash in Columbia, South Carolina, late on Friday, Sept. 19, which led to the deaths of pilots Sarah Lemmon and James Bland, as well as Chris Baker and Charles Still, who worked for the musicians.


One of the first responders to the crash has said that Barker and DJ AM escaped the flaming wreckage by sliding down the jet’s wing.

“They said the plane went down. They didn’t say how or if they knew,” Lt. Jason Shumpert of the South Congaree Police Department told the Associated Press. “Once it went down, they were able to slide down the wing of the plane, and they jumped on each other to put fires on each other out and rolled around on the ground.”

Travis Barker: Hero

You guys know how flying freaks me out. So, I've been a little obsessive in reading accounts of DJ AM (real name: Adam Goldstein) and Travis Barker's crash. It's really amazing they made it out. I read yesterday that AM's Facebook status reads: "Adam Goldstein is ALIVE!!!" It gave me chills. Amazing.

Plane crash update: From what we're hearing, Travis Barker is a hero. When the doomed plane started hurtling about, Travis and DJ AM were sitting in the front seats. They turned around and saw a ball of fire roaring in the back of the plane and watched in horror as it engulfed their friends seated in the back. Travis realized what was coming and he pushed the door open and grabbed DJ AM and pulled him out of the moving plane. They were both on fire and ran screaming as fast and as far from the fiery plane as they could. DJ AM can't sleep and somehow is able to text friends in spite of his hand burns. He's worried about his scalp being burned off. Travis is quiet - he's on more painkillers.
